TRAVELLER’S INFORMATION

 

1. General

1.1. Hereby, the rights and liabilities of the Passenger, Lux Charter OÜ (company) and the company’s Bus Driver as well as Booker in case of a Charter Trip are affirmed.

1.2. Definitions:

1.2.1 “Lux Charter” is Lux Charter OÜ, register code 14371875, with office at Odra 16, 10144 Tallinn.

1.2.2. Request of a quote – request sent to the company by a person in order to inquire after the possibility, time and conditions of a Charter Trip.

1.2.3. Timetable – description of a Charter Trip’s route, stops, destination, departure and arrival times affirmed as a part of the request.

1.2.4. Price offer – the company’s answer to a request of a quote, which includes the price, date and other specifications (ie. ferry tickets, accommodation).

1.2.5. Booking – a positive reply of the sender of the request of a quote to the price offer.

1.2.6. Affirmed booking – company’s decision affirmed in written form to offer the Booker a Charter Trip as specified in the conditions affirmed in the Price Offer.

1.2.7. Booker – the person who enters a contract with the company and becomes liable to pay according to the Affirmed contract.

1.2.8. Customer – a person who is being transported according to the Contract (Affirmed booking) between the company and the Booker.

1.2.9. Charter Trip – a transport service offered by the company according to an Affirmed booking in order to transport Customers according to the Timetable.

 

2. Customer

2.1. Customer can not change the conditions of the contract onesidedly.

2.2. Customer has to abide by the Timetable and take into account that if he or she is late to the bus serving the Charter Trip, the Bus Driver has the right to decide, along with the Booker, whether or not to wait for the Customer.

2.3. Customer has to fasten the safety belt before the begin of the bus ride.

2.4. Customer has to obey the Bus Driver’s orders that have to do with the bus ride and the safety of other Customers.

2.5. Customer is not allowed to consume alcohol or smoke in the bus.

2.6. Customer is not allowed to disturb the Bus Driver during the bus ride.

2.7. Customer is not allowed to stand during the bus ride, unless there are special standing places in the bus.

2.8. Customer is not allowed to consume drinks from an open cup during the bus ride.

2.9. Customer is not allowed to damage the interior of the bus or to use it disfunctionally.

2.10. Customer has to present his or her luggage in a way that would not cause the luggage of other Customers to go missing or get damaged or any damage to the luggage compartment of the bus. It is not allowed to transport luggage that contains forbidden matters or items: radioactive, explosive, poisonous, cauterizing, flammable, malodorous and blemishing matters, as well as matters and items that can blemish or damage the bus.

2.11. Customer is responsible for the contents of his or her luggage.

2.12. Customers have the right to refrain from using the Charter Trip. In that case, the Company retains the rights deriving from the Affirmed Booking.

 

3. Bus Driver

3.1. Bus Driver may refuse to start or continue the ride, if:

3.1.1. Customers do not fasten their safety belts;

3.1.2. Customers disturb the Bus Driver;

3.1.3. Customers smoke or consume alcohol or drinks from an open cup in the bus;

3.1.4. Customers damage the bus interior;

3.1.5. Customers endanger the safety of the bus ride and other Customers and/or do not obey the Bus Driver’s orders that have to do with the bus ride and the safety of other Customers;

3.2. Bus Driver has the right to choose the fastest and shortest route and not abide by the route affirmed by the Timetable if the next arrival (affirmed by the Timetable) is in danger of not being on time. Bus Driver has to inform Customers of this change in the Timetable.

 

4. Company

4.1. Company has to ensure that a bus, in a good technical condition and equipped with a bus driver (bus drivers), is at the affirmed place at the right time, as ratified by the conditions of the Affirmed booking.

4.2. Company has to give the Booker the registration number of the bus, the Bus Driver’s name and phone number on the previous day of fulfilling the Affirmed booking.

4.3. In case of a technical problem of the bus, the company has to do everything they can in order to solve the problem and ensure the continuation of the Charter Trip. When necessary, the company has to replace the bus in a bad technical condition with an equal bus.

4.4. Company is not responsible for possible damages which have been caused or can be caused to the Customer because of not abiding by the Timetable on grounds of reasons not being caused by the Company, including delays of the Charter Trip caused by the Customer.

4.5. Company has the right to cancel offering the Charter Trip service and/or demand the reimbursement of damages, if Customers who are receiving the Charter Trip Service do not abide by the requirements ratified by the point nr 2.

 

5. Booker

5.1. Booker has to pay for the Charter Trip according to the requirements in the Affirmed booking and the bills issued by the Company.

5.2. Booker has to reimburse to the Company the damage caused by Customers to the bus during the Charter Trip.

5.3. If it is not been agreed otherwise in the Affirmed booking, the Booker has to pay for any other additional costs (ferry tickets, road taxes, parking, accommodation, etc).

5.4. If it has not been agreed otherwise in the Affirmed booking, the Booker has the right to cancel the Affirmed booking without any sanctions 3 weekdays before the planned start of the Charter Trip.

 

6. Time constraints on carriage on a coach

6.1.The Passenger(s) shall be entitled to carriage on a coach with 1 driver for up to 10 hours, including up to 9 hours of travelling time, in a 24-hour period. Entitlement to carriage on a coach with 2 drivers shall be up to 20 hours, including up to 18 hours of travelling time, in a 24-hour period.

6.2.Carriage on a coach shall adhere to / allow for breaks and resting time established for a Driver under Directive 561/2006 of the EU:

6.2.1.After a driving period of four and a half hours a driver shall take an uninterrupted break of not less than 45 minutes, unless he takes a rest period. This break may be replaced by a break of at least 15 minutes followed by a break of at least 30 minutes each distributed over the period in such a way as to occur within a driving period of four and a half hours.

6.2.2.A coach driver’s daily uninterrupted rest period shall be at least 11 hours. Alternatively, this regular daily rest period may be taken in two periods, the first of which must be an uninterrupted period of at least 3 hours and the second an uninterrupted period of at least nine hours.

6.3.Duration of travel shall be calculated to the nearest 0.5 hours. Any time under 0.5 hours shall be assessed as 0.5 hours and any time over 0.5 hours as 1 hour.

 

 

TERMS AND CONDITIONS OF SALES

 

1. Booking a charter service takes place as described in the following:
1.1. The Booker requests a quote. (By filling the form found on the charter website, by e-mail, by phone);
1.2. Lux Charter OÜ (hereinafter Lux Charter) replies to the request of a quote (by e-mail or by phone);
1.3. The Booker confirms the Booking, by which he accepts the price quote offered by Lux Charter;
1.4. In one weekday, Lux Charter sends the Booker a confirmation of his booking. Once the booking is confirmed, the charter contract is held for concluded;
1.5. The Booker has a right to immediately place a booking, without requesting a quote first. The booking has to comply with the requirements applying to it.

 

2. Requirements applying to the request of a quote
2.1. The request of a quote is forwarded in written form. The request of a quote has to contain the following information:
2.2. Date of the beginning of the planned trip, as well as the time and address (departure);
2.3. Date of the end of the planned trip, as well as the time and address (destination);
2.4. Route of the trip (separately for every day, including times and destinations);
2.5. Number of passengers;
2.6. Personal data of the Booker (name of the company/individual, location/home address, phone number and e-mail address, contact person);
2.7. Any additional information the person requesting a quote considers as being of importance.

 

3. Price
3.1. Prices offered contain the following: bus rental, bus driver’s salary and daily allowance, fuel;
3.2. To the price will be added: driver’s accommodation costs, ferry and ship tickets, road and bridge taxes, parking, ecological taxes and other similar costs;
3.3. Lux Charter preserves the right to raise the price of a confirmed Booking, when announcing this to the Booker at least 14 days before the service is to be offered, if the following circumstances arise:
3.3.1. the taxes, fees and service charges pertinent to the offered service increase and affect the price of the service;
3.3.2. upon the increase of transport and fuel costs, which are not subject to Lux Charter’s control and which could not be foreseen upon confirming the booking.

 

4. Invoicing
4.1. The Booker is obliged to pay the bill by the date shown on the invoice.
4.2. If the sum has not been paid by the due date, Lux Charter has the right to demand 0.3% overdue charge for every day the bill is overdue.
4.3. The Booker can pay for the charter service in the following ways: by transaction or in cash.

 

5. Cancellation of the booking: the Booker has a right to cancel or change his order by giving the Service Provider advance notice of 3 (three) full days, counting from the day that precedes the day when the service was to be provided. It is not possible to change or cancel bookings by phone.
5.1. If the Booker does not comply with the aforementioned terms, Lux Charter has a right to ask indemnifications at the following rates: Applying to interstate trips: 25% of the charter’s fixed price without VAT, if the order is cancelled 3 (three) days before the planned charter service was to be provided; 50% of the charter’s fixed price without VAT, if the order is cancelled 2 (two) day before the planned charter service was to be provided; 100% of the charter’s fixed price without VAT, if the order is cancelled on the day when the planned charter service is to be provided.
5.2. The Booker agrees to pay the cancellation indemnification in 7 (seven) days starting from the day when this claim was issued.

 

 

TERMS AND CONDITIONS OF CANCELLATION

 

The Booker has a right to cancel or change his order by giving the Service Provider advance notice of 3 (three) full days, counting from the day that precedes the day when the service was to be provided. It is not possible to change or cancel bookings by phone.

If the Booker does not comply with the aforementioned terms, Lux Charter has a right to ask indemnifications at the following rates:

 

Applying to interstate trips:

25% of the charter’s fixed price without VAT, if the order is cancelled 3 (three) days before the planned charter service was to be provided;

50% of the charter’s fixed price without VAT, if the order is cancelled 2 (two) days before the planned charter service was to be provided;

100% of the charter’s fixed price without VAT, if the order is cancelled 1 (one) day before the planned charter service was to be provided;

100% of the charter’s fixed price without VAT, if the order is cancelled on the day when the planned charter service is to be provided.

 

The Booker agrees to pay the cancellation indemnification in 7 (seven) days starting from the day when this claim was issued.
